Terms of Service

1. Acceptance of Terms

By accessing or using ScheduleBeats ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

ScheduleBeats is a SaaS platform that helps music producers automate beat uploads to BeatStars and YouTube. We provide scheduling, video generation, and automated publishing services using your connected accounts.

3. Account Registration

To use our Service, you must:

• Create an account with accurate and complete information
• Be at least 18 years old or have parental/guardian consent
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Have valid accounts on BeatStars and/or YouTube for integrations

4. Subscription Plans & Pricing

ScheduleBeats offers multiple subscription tiers:

• Free: Basic features with limitations
• Consistency+ ($9.99/month): Full features, 1080p videos
• Born For This ($19.99/month): Premium features, 4K videos, Clip Mode

Prices are in USD and may be subject to change. We will notify existing subscribers of any price changes at least 30 days before they take effect.

5. Payment Terms

All payments are processed securely through Stripe, our third-party payment processor.

• Subscriptions are billed monthly in advance
• Payment is due at the start of each billing cycle
• We accept major credit cards and other payment methods supported by Stripe
• All fees are exclusive of taxes, which may be added where applicable
• You authorize us to charge your payment method for all fees incurred

6. Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled. You will be charged the then-current subscription fee using the payment method on file. You can manage your subscription and view your next billing date in your account settings or through Stripe's customer portal.

7. Cancellation Policy

You may cancel your subscription at any time:

• Go to Settings > Account or use Stripe's customer portal
• Cancellation takes effect at the end of your current billing period
• You will retain access to premium features until the end of the paid period
• After cancellation, your account will revert to the Free plan
• No partial refunds are provided for unused time

8. Refund Policy

All sales are final. We do not offer refunds.

Due to the digital nature of our Service and the immediate access to premium features upon subscription, we do not provide refunds for any reason, including but not limited to:

• Unused subscription time
• Dissatisfaction with the Service
• Failure to cancel before renewal
• Technical issues with third-party platforms (BeatStars, YouTube)
• Account suspension due to Terms violation

We strongly encourage you to use our Free plan to evaluate the Service before upgrading to a paid subscription. If you experience technical issues, please contact our support team and we will do our best to resolve them.

9. User Responsibilities

You are responsible for:

• All content you upload through our Service
• Ensuring you have the rights to distribute your music
• Complying with BeatStars and YouTube terms of service
• Maintaining accurate metadata for your beats
• Any collaborator agreements and royalty splits
• Keeping your payment information current

10. Content Ownership

You retain all ownership rights to your music and content. By using our Service, you grant us a limited, non-exclusive license to store, process, and transmit your content solely for the purpose of providing the Service (uploading to BeatStars and YouTube on your behalf). We do not claim any ownership of your content.

11. Prohibited Content & Use

You may not:

• Upload content that infringes copyrights or intellectual property rights
• Use uncleared samples without proper licensing
• Violate BeatStars or YouTube community guidelines
• Upload illegal, harmful, or fraudulent content
• Attempt to reverse engineer or exploit the Service
• Share your account credentials with others
• Use the Service for any unlawful purpose

12. Third-Party Platforms

Our Service integrates with BeatStars, YouTube, and Stripe. Your use of these platforms through our Service is subject to their respective terms of service and privacy policies. We are not responsible for changes to these platforms that may affect Service functionality. We will make reasonable efforts to maintain compatibility but cannot guarantee uninterrupted integrations.

13. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. Scheduled uploads may be delayed due to technical issues, platform changes, or maintenance. We will make reasonable efforts to notify users of significant service disruptions. The Service is provided "as is" without warranties of any kind.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• ScheduleBeats is provided "AS IS" without warranties of any kind
• We are not liable for any indirect, incidental, special, or consequential damages
• We are not responsible for failed or delayed uploads
• We are not responsible for changes to third-party platforms
• We are not responsible for account suspensions on BeatStars or YouTube
• We are not responsible for lost revenue or missed opportunities
• Our total liability shall not exceed the amount you paid in the last 12 months

15. Indemnification

You agree to indemnify and hold harmless ScheduleBeats, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your content, or your violation of these Terms.

16. Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms, at our sole discretion. You may delete your account at any time from your settings.

Upon termination, your stored content will be deleted within 30 days. Any active subscription will be cancelled without refund. Content already uploaded to BeatStars and YouTube will remain on those platforms.

17. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes via email or in-app notification at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the Service.

18. Governing Law & Disputes

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration or in courts of competent jurisdiction. You agree to waive any right to participate in class action lawsuits against ScheduleBeats.

19. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
